2. Purpose and Acceptance
These Terms govern access to and use of SportanPlay (the "Platform"), a sports matchmaking service that lets you discover nearby matches (with a focus on padel), request to join them, organise your own, communicate with other participants and rate the playing experience.
By registering or using the Platform you accept these Terms, the Privacy Policy and the Cookie Policy. If you do not agree, you must not use the service.
3. Eligibility
- You must be 18 years of age or older. By registering you confirm that you are.
- You must provide truthful information and keep it up to date.
- Each person may hold a single account, which is personal and non-transferable. You are responsible for keeping your credentials confidential and for all activity carried out from your account.
4. The Service
SportanPlay is an intermediation platform: it connects people interested in playing sports matches. SportanPlay does not organise the matches, does not manage or rent sports facilities, does not verify users' identity or abilities, and does not take part in the meetups.
The service is currently provided free of charge. We reserve the right to introduce paid features in the future, which will be communicated in advance and will require your express acceptance.
5. Rules of Use
By using the Platform you agree to:
- Use it solely for its purpose: organising and taking part in real sports matches.
- Treat other users with respect, both on the Platform (messages, feedback) and at in-person meetups.
- Not post content that is illegal, defamatory, offensive, discriminatory, violent or infringing third-party rights.
- Not impersonate others or create fake accounts.
- Not use the Platform for unauthorised commercial, advertising or solicitation purposes.
- Not harass, intimidate or contact other users in unwanted ways.
- Not attempt to breach the Platform's security, access third parties' data, or use automated means (bots, scrapers) without authorisation.
- Attend the matches you commit to, or cancel your participation with reasonable notice; repeated no-shows may affect your reputation and lead to account measures.
6. User-Generated Content
6.1 Your content
You are solely responsible for the content you post (messages, feedback, match details and profile information). You warrant that you hold the necessary rights to it.
6.2 Licence
By posting content on the Platform you grant its owner a non-exclusive, royalty-free, worldwide licence to host, reproduce and display it within the Platform, for the sole purpose of providing the service. This licence ends when you delete the content or your account, except for content that by its nature must persist (e.g., anonymised feedback — see the Privacy Policy).
6.3 Feedback
The rating system exists to build trust between players. Ratings must be honest and based on real playing experiences. Fake, coordinated, extortionate or non-sport-related ratings are not allowed.
6.4 Moderation
We may review, hide or remove content that breaches these Terms, and warn, suspend or terminate the accounts responsible, with notice to the user except in justified urgent cases.
7. In-Person Meetups: Your Responsibility
Matches organised through SportanPlay take place in the real world between people who may not know each other. By using the Platform you understand and accept that:
- SportanPlay does not verify users' identity, background or physical condition.
- You are responsible for assessing whether to attend a match and for taking reasonable precautions (public venues, informing someone you trust, etc.).
- Sport involves an inherent risk of injury. You take part at your own risk; we recommend holding insurance and consulting a doctor if in doubt about your fitness.
- SportanPlay is not liable for damages, injuries, losses, disputes or breaches that may occur at meetups between users, nor for the booking, condition or cost of sports facilities.
Nothing in this section excludes liability that cannot legally be excluded.
8. Intellectual Property
The Platform (software, design, brand, texts and other elements, excluding user content) belongs to its owner or is duly licensed. You are granted no rights over it other than using the service in accordance with these Terms.
9. Service Availability
SportanPlay is at an early stage (product under validation). The service is provided "as is" and "as available": we do not guarantee uninterrupted availability or absence of errors, and we may modify, suspend or discontinue features — or the entire service — for technical, security or business reasons. Should the service be discontinued, we will give reasonable advance notice so you can retain the information you need.
10. Suspension and Termination
- By you: you may delete your account at any time from the Platform or by request to contacto@sportanplay.com.
- By us: we may suspend or terminate your account for breach of these Terms, fraudulent use, or risk to other users or the Platform. Except in urgent cases, we will notify you stating the reason and, where appropriate, give you an opportunity to remedy.
11. Limitation of Liability
To the maximum extent permitted by law, the owner's total liability to you for any claim arising from the use of the Platform shall be limited to the amount you paid for the service in the preceding 12 months (the service being free, this may mean no compensation). This limitation does not apply to damage caused by wilful misconduct or gross negligence, nor to any liability that cannot be limited by law (including your statutory consumer rights).
12. Changes to These Terms
We may amend these Terms. Substantial changes will be communicated at least 15 days in advance by email or notice in the Platform. If you disagree, you may delete your account before they take effect; continued use after that date constitutes acceptance.
13. Governing Law and Jurisdiction
These Terms are governed by Spanish law. Any dispute shall be submitted to the courts determined by consumer protection rules; if you act as a consumer resident in Spain, the courts of your place of residence.
